1. Acceptance of Terms

Welcome to CAS Parser. By accessing or using our website (casparser.in), API, or any services offered by Kumar & Co. ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

CAS Parser provides tools and services to parse and convert Consolidated Account Statements (CAS) from CAMS, KFintech, CDSL, and NSDL into structured formats such as JSON, CSV, and Excel. Our services include both a web interface and API access depending on the subscription plan.

3. Account Registration

To access certain features of our services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. API Usage and Rate Limits

If you use our API services:

  • You must adhere to any rate limits and usage restrictions specified in your subscription plan.
  • You may not attempt to circumvent any technical limitations or restrictions in our API.
  • API access is personal to you and may not be shared, resold, or transferred without our express written consent.
  • We reserve the right to modify, suspend, or discontinue the API at any time with or without notice.

5. Subscription and Payment

We offer various subscription plans with different features and usage limits. By subscribing to a paid plan, you agree to pay all fees associated with your selected plan.

All payments are non-refundable unless otherwise specified or required by law. We reserve the right to change our pricing at any time, with notice provided to current subscribers before changes take effect.

6. Data Usage and Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We do not store CAS PDF files or the financial data contained within them after processing is complete. However, we may collect and retain certain usage data to improve our services.

We adhere to all requirements set forth by the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and other applicable Indian data protection regulations.

7. User Obligations

When using our services, you agree:

  • Not to use our services for any unlawful purpose or in violation of any applicable regulations;
  • Not to attempt to gain unauthorized access to any part of our services or any systems or networks connected to our services;
  • Not to use our services to transmit any viruses, malware, or other harmful code;
  • Not to use automated means, including bots, scrapers, or similar technologies to access our services, except as expressly permitted via our API;
  • To ensure that any data you submit to us is obtained lawfully and that you have the right to share such data with us.

8. Intellectual Property

Our services, including all content, features, and functionality, are owned by Kumar & Co. and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our services for your personal or internal business purposes.

9. Third-Party Links and Services

Our services may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KUMAR & CO., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
  • ANY CONTENT OBTAINED FROM THE SERVICES; AND
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT,

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kumar & Co., its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our services, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. All services provided are in strict compliance with Indian regulations, including data localization requirements that mandate storage of Indian users' data within the territory of India. In case of any dispute, the courts in New Delhi, India shall have exclusive jurisdiction. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kumar & Co. regarding our services and supersede all prior agreements or understandings, whether written or oral.
